Brain and spinal cord injury lawsuits may be settled outside of court, by judicial decree or by a jury's verdict. In cases that do go to court, either party or both parties can appeal to a higher court and seek to have the decision reversed, amended or sent back down to the lower court for a new trial. There is no appeals process for settlements and, absent special circumstances, they will generally not be overturned by the courts.

What's Fair?
In a sense, there is only one answer to this question. Fair is whatever a judge or jury says is fair or, whatever amount of compensation you are willing to accept from the defendant's insurance company.
That said — the medical costs associated with caring for a loved one who has suffered a brain or spinal cord injury are high. Economic losses of income and earning potential can also be high. There are also hidden costs to account for such as periodic replacement costs for medical equipment or home remodeling.
"Non-economic" injuries such as a loss of enjoyment of life, loss of companionship and support, loss of consortium, pain, suffering and more are also significant and should not be underestimated.
